Michigan Drug Possession Laws

The possession of drugs can result in some serious penalties including large fines and jail time. If you have been charged with a drug crime, it’s important to understand the drug charges you may be facing and the penalties you are going up against.

Possession of Schedule I and Schedule II drugs such as cocaine, heroin, and methamphetamine is a crime that can lead to even more dire consequences under the law. Schedule I and Schedule II drug charges will always be a felony drug charge. Unlike marijuana, the penalties you’ll be faced with will depend on the amount you have in possession at the time of your arrest.

Under Michigan Law:

  • Less than 50 grams – 4 years and/or a fine of $25,000
  • 50-450 grams – 20 years and/or a fine of $250,000
  • 450-1,000 – 30 years and/or a fine of $500,000
  • More than 1,000 grams – Life sentence and/or a fine of $1,000,000

In the state of Michigan, the law remains that possession of marijuana is still considered a crime. Under Michigan law, you are susceptible to a criminal charge no matter how much of the drug you are in possession of. Marijuana possession is a misdemeanor drug charge that can result in a $2,000 fine and one year of jail time. Our lawyers can help your defense in the case of a marijuana possession charge and work to free you of major penalties.

Michigan Drug Distribution Laws

Under Michigan law, you can face several years of jail time if you are charged with possession with intent to sell or drug distribution. Selling drugs and controlled substances can result in severe consequences under Michigan law. The penalties of selling drugs depend on which drugs are distributed and how much of each substance.

If you are charged with drug distribution of a Schedule I or Schedule II controlled substance in Michigan, it’s more likely that you will face more serious penalties, including jail time and hefty fines. You will need a skillful, persistent lawyer with experience handling both felony and misdemeanor drug charges in Michigan. At Jaffe Law Group, we have more than three decades of legal experience and are ready to ensure that the state's allegations against you receive the examination and consideration they deserve.
